If an EU Member State fails to rectify a suspected violation of EU law, the European Commission may launch a formal infringement procedure. Within the framework of the procedure, if the state does not comply after the Commission sends an explanation as to why it considers the state to be in breach of EU law, the Commission may decide to refer the matter to the Court of Justice of the EU (CJEU). If the Court finds that a country has breached EU law, the national authorities must take action to comply with the Court’s judgment.
